1. About MIDAS
MIDAS provides jewellery design, manufacturing and custom-made jewellery services. The business is operated by DIVYARATNE GEMS AND JEWELLERY PRIVATE LIMITED (“MIDAS”, “we”, “us” or “our”).
Registered address: Floor 2, Sangam, Sinhgad Road, Anand Nagar, Pune, Maharashtra 411051, India.
2. Website use and designs
- You must provide accurate information when enquiring, placing an order or arranging delivery.
- Website images, renderings and previews are intended to illustrate a design. Appearance can vary with screen settings, production methods, materials, finish, stones and approved specifications.
- Only designs and variants expressly shown as available for public purchase may be ordered through online checkout.
- Unless separately agreed in writing, website content, MIDAS design files, drawings, images, branding and other intellectual property remain the property of their respective rights holders. You must not copy, redistribute or commercially exploit them without permission.
- If you submit a design or other material for custom work, you confirm that you are entitled to provide it and request the work. You remain responsible for respecting third-party rights.
3. Product specifications and customisation
Before paying, review the selected design, metal type, purity, finish, size, dimensions, stones and any customisation notes. MIDAS will manufacture according to the specifications accepted for the order.
- Custom requests are subject to technical feasibility, material availability and MIDAS approval.
- Changes requested after order confirmation may affect price, production time or feasibility and require written approval and, where applicable, an additional payment.
- Natural materials, handcrafted work and production processes may result in reasonable variations. Any material deviation from the agreed specifications should be raised with MIDAS.
4. Prices, GST and shipping
- The applicable price and available material or finish options are those confirmed for the selected design and variant at checkout.
- Where GST or another applicable tax is payable in addition to the displayed item price, the applicable amount will be shown in the checkout breakdown before payment.
- Shipping charges are calculated or confirmed for the delivery destination and are shown separately where applicable.
- The total displayed for confirmation before payment is the amount MIDAS will submit for payment, subject to server-side validation and any correction required before the order is accepted.
- If a clear pricing, calculation or technical error is discovered, MIDAS will contact the customer to resolve it before proceeding where appropriate. MIDAS will not knowingly treat an incorrect amount as an agreed price.
5. Orders and payment
- Submitting checkout details or opening a payment window does not by itself confirm that payment succeeded.
- An order is treated as paid only after the payment status has been verified by MIDAS's payment system or payment provider.
- If payment fails, remains pending or its status is unclear, do not make repeated payments without checking the order status or contacting MIDAS.
- Please retain your order reference and payment confirmation for future communication.
- MIDAS may contact you to clarify specifications, delivery details or payment status before processing an order.
6. Cancellation, returns and refunds
Custom-made orders
Cancellation is restricted once production has started, except where required by applicable law or approved by MIDAS. Custom-made items may have been produced specifically to the customer's selected design, material, size or other specifications.
Before production starts
If you wish to cancel, contact MIDAS as soon as possible and provide your order number. A request is not effective until MIDAS confirms its outcome. Any refund or deduction will be assessed under the agreed order terms and applicable law.
Faults, damage or incorrect items
If an item arrives damaged, appears faulty or does not match the agreed order specifications, contact MIDAS promptly with your order number and clear photographs where relevant. MIDAS will review the matter and determine an appropriate remedy in accordance with applicable law and the facts of the order.
Refund processing
Where a refund is approved or legally required, it will be processed through an appropriate payment method and within the applicable legal or payment-provider timeframe. Any mandatory consumer rights remain unaffected by these terms.
7. Delivery
- You are responsible for providing a complete and accurate delivery address, mobile number and PIN code.
- Any delivery estimate is indicative unless expressly confirmed as guaranteed in writing. Timing may be affected by production, courier operations, weather, access restrictions or other events outside reasonable control.
- Please inspect the parcel and item on receipt. If there is visible transit damage, a missing item or an apparent mismatch, keep the packaging and contact MIDAS promptly.
- Courier service, tracking and delivery arrangements may be handled by third-party logistics providers under their applicable terms.
8. Personal information
MIDAS uses the information you provide to process orders, communicate with you, arrange delivery, handle payments and resolve customer-service issues. Payment details may be processed by the relevant payment provider. Information may be shared with service providers where reasonably necessary to fulfil these purposes or where required by law.
Do not send payment passwords, one-time passwords or private payment credentials to MIDAS. Any separate privacy notice published by MIDAS should be read together with these terms.
9. Website availability and liability
We aim to keep the website information accurate and the service available, but do not guarantee uninterrupted access or that every preview, feature or third-party integration will always be error-free.
To the extent permitted by applicable law, MIDAS is not responsible for indirect loss arising from temporary website or third-party service interruptions. Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.
10. Applicable law and disputes
These terms are subject to the laws applicable in India. Any dispute will be handled by the competent forum under applicable law. Nothing in this section removes any mandatory rights or remedies available to a consumer under applicable law.
11. Changes to these terms
MIDAS may update these terms when business practices, services or legal requirements change. The date at the top indicates the latest revision. The terms applicable to an order will be read alongside the order confirmation and any specific terms agreed with the customer, subject to applicable law.
12. Contact
For questions about these terms, an order, a cancellation request or a delivery issue, contact MIDAS using the contact details published on the official MIDAS website and quote your order number where available.
